TERMS AND CONDITIONS OF BUSINESS

 

 

1. These terms and conditions are between Kidscape Nursery Recruitment (“the agency”) and the employer (“the Client”). They are deemed to have been accepted by the Client upon interview or engagement of an applicant introduced by the Agency. For the avoidance of doubt, “engagement” occurs once a contract of employment has been entered into, this will usually mean the date upon which the written contract was signed by both Client and applicant.

 

2. The Client is responsible for agreeing pay and conditions with the Applicant prior to making the engagement. The Client warrants that conditions relating to pay, Tax, National Insurance, working hours, accommodation, notice and grievances shall be notified in writing to the Applicant upon engagement.

 

3. The Client agrees to notify the Agency when an engagement has been made and to provide the Agency with a copy of the written, signed contract of employment, the letter offering employment and the relevant agency fee prior to the commencement of employment.

 

4. The Agency’s fees and terms of remuneration will be those applicable and published at the time of the engagement or, in the case of re-engagement those applicable at the date of re-engagement

 

5. The details of all Clients and Applicants will be treated confidentially by the Agency. In the same way, the Client undertakes to treat the Applicant’s details confidentially, in addition the Client must not pass on those details to any third party.

 

6. The Agency takes all reasonable care to interview applicants, take up references, and investigate qualifications, attitude and experience. The Client nevertheless undertakes to use best endeavors to ascertain that the Applicant is in fact a suitable person for the position and that the terms and conditions offered in the contract of employment are suitable to the Applicant.

 

7. The Agency accepts no liability for loss, damage and/or expense caused to the Client or others through the acts or omissions of the Applicant, nor for acts in breach of the Applicant’s contract with the Client. Once the Applicant is placed by a Client the Applicant and their actions are no longer the responsibility of the Agency.

 

8.  The Client will be invoiced on the date that the Applicant commences employment.  It is the Clients responsibility to inform Kidscape Nursery Recruitment if the Applicant will not be commencing employment.  Payment should be received within 14 days of invoice date.  If payment is not received by that date then a 20% charge will be added to the account. Should Kidscape Nursery Recruitment have to instruct Solicitors to recover fees the Solicitors charges will be added to the account.

 

9. Should the Applicant fail to take up the appointment we will endeavor to find a suitable replacement as soon as possible.

BETWEEN ONE AND TWO WEEKS	50% LESS £50 ADMINISTRATION FEES
BETWEEN TWO AND FOUR WEEKS	20% LESS £50 ADMINISTRATION FEES

 

10.  If it is not possible to find a suitable replacement of an Applicant then the Agency will refund the Client within 30 days according to the table above.

 

11. Should the Client obtain a candidate through the Agency (whether directly or indirectly) or re-engage a candidate of the Agency, the Client agrees to notify the Agency immediately and acknowledges that fees will be payable on engagement.

Temporary Worker

Full Time	Part Time – up to 5 hours per day
£10 per day	£5 per day
£40 per week	£20 per week
